1. The Service
POVV runs adversarial ensembles of large language models over a bounded snapshot of a software repository and synthesizes their outputs into a sealed, cryptographically signed verdict (the “Verified Merit Index” or “VMI”, together with its narrative, risks, priorities, and evidence manifest — a “Verdict”). Every Verdict is an automated opinion generated without human review.
2. Automated opinion — not advice, not certification
Verdicts are produced by probabilistic AI systems reasoning over a partial, disclosed evidence base (the exact files and byte counts are listed in each Verdict’s evidence manifest). Verdicts (a) may contain errors, omissions, or mischaracterizations; (b) do not constitute legal, financial, investment, security, or engineering advice; (c) are not a security audit certification, penetration test, or compliance attestation under any framework (including SOC 2, ISO 27001, or PCI-DSS); and (d) must not be the sole basis for any investment, acquisition, hiring, or deployment decision. A high VMI is not a warranty that software is secure or defect-free; a low VMI is not proof that it is defective.
3. Your repository, your rights
You retain 100% ownership of every repository you submit and all source code in it. POVV acquires no rights to your code. Private-repository content is processed in memory for the duration of the audit; sealed Verdicts for private repositories carry cryptographic hash anchors of evidence, never verbatim source. You warrant that you own or are authorized to audit every repository you submit, and that submitting it violates no law, contract, or third-party right.
4. POVV’s intellectual property
POVV retains 100% ownership of the Cognitive Swarm methodology, persona matrices, orchestration logic, prompts, the VMI standard, and all service software. Verdict documents you generate for repositories you own may be shared freely (including the public /v/<hash> page and badge for public repositories).
While your account is active you may access every Verdict generated for you at povv.io and download it as a Markdown document, so the record does not live only inside our product.
POVV does not publish a Verdict about your repository publicly without your consent. Publication happens when you choose it — the public /v/<hash> page and badge exist for verdicts their submitter elects to publish, and verdicts for private repositories are never published. Separately, and without publishing anything about you, POVV uses the outputs it generates to improve its own services, as described in the Privacy Policy.
5. Acceptable use
You may not: submit repositories you lack rights to; attempt to extract the service’s prompts or personas; probe, overload, or circumvent rate limits, quotas, or access controls; use Verdicts to harass, defame, or target third parties; or resell raw service access without a written agreement. POVV publishes sealed numeric Verdicts only for audits initiated by an authenticated account against that account’s configured repositories, or anonymous audits of public repositories initiated by their submitter.
The Service runs on third-party model providers. You must not use it in any way that would breach their acceptable-use policies, including those of Anthropic and xAI. POVV may suspend or terminate access — with notice where practicable, immediately where it is not — for violation of this Section, abuse of rate or spend limits, fraud or chargeback abuse, or where an upstream provider requires it or continued use would put our access to that provider at risk.
6. Plans, quotas, and payment
Paid tiers are billed through Stripe under the pricing shown at purchase. Quotas (audits per period) are metered per account. Refunds are governed by the Refund Policy, which forms part of these Terms and states plainly what is refundable and what is not. POVV may change prices prospectively with notice.
Prices are shown exclusive of tax. Applicable VAT or sales tax is calculated and added at checkout by Stripe Tax, based on your location and the status you declare there, and appears on your invoice. The total shown before you confirm is the total you pay.
The seller’s own VAT registration is being completed. That does not affect the tax calculated at checkout, which follows your location and status. Once the registration is effective the VAT identification number will appear here and on your invoice, and reverse-charge invoicing will be available to EU business customers who supply a valid VAT identification number. Invoices are issued by the contracting entity named in Section 15.
Credits are the unit the engine meters against. Credits included with a subscription are granted monthly and form part of that month’s service; credits you buy as a top-up are added to the same balance. Unused credits expire 90 days after your most recent payment. Any top-up or subscription renewal resets that deadline for every credit still in your balance; if you have never paid, each credit expires 90 days after it was credited. Credits are not money, carry no cash value and are not redeemable for cash. If you cancel a subscription, credits already in your balance remain usable until that expiry date — but a cancelled subscription makes no further payments, so the deadline stops moving. Credits that have already expired are not restored by a later payment.
7. Right of withdrawal (consumers)
If you are a consumer in the European Union you generally have 14 days to withdraw from a distance contract without giving a reason. POVV is a digital service supplied on demand: when you start a purchase you expressly request that performance begin immediately, and you acknowledge that you lose the right of withdrawal once the service has been fully performed. Where performance has begun but is not complete, you may still withdraw and will owe only the proportion already delivered.
In operational terms, POVV refunds what you have not consumed. An audit that has already run is performance delivered, and the third-party model inference behind it was purchased and cannot be recovered; credits still unspent in your balance are refundable. The Refund Policy sets this out case by case. To withdraw, email [email protected] within 14 days of purchase — no form and no reason required. Nothing in these Terms limits mandatory consumer rights under Polish or EU law; where they conflict, those rights prevail.
8. Business customers
Where you purchase in the course of a business you are not a consumer, and the withdrawal right in Section 7 does not apply. What you buy is access to the automated audit service at the plan, quota and term shown at purchase. Subscriptions renew monthly until cancelled; cancellation takes effect at the end of the period already paid for. Fees are payable in advance through Stripe in the currency displayed.
Excluded from every plan unless separately agreed in writing: manual review by a human, remediation or development work, penetration testing, formal compliance attestation, guaranteed detection of any particular defect, uptime commitments, and support response times. A Verdict remains an automated opinion bounded by the evidence disclosed with it — see Section 2. Business customers who need a signed data processing agreement, a subprocessor list, or an order form naming their legal entity should contact [email protected]; the processors we use are published at /legal/subprocessors.
9. Disclaimer of warranties
THE SERVICE AND ALL VERDICTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. POVV DOES NOT WARRANT THAT VERDICTS ARE CORRECT OR COMPLETE, THAT THE SERVICE WILL BE UNINTERRUPTED, OR THAT AUDITS WILL SURFACE ANY PARTICULAR DEFECT, VULNERABILITY, OR ZERO-DAY.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POVV AND ITS PERSONNEL AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR ANY VERDICT, EVEN IF ADVISED OF THE POSSIBILITY. POVV’S AGGREGATE LIABILITY FOR ALL CLAIMS IN ANY 12-MONTH PERIOD SHALL NOT EXCEED THE AMOUNTS YOU PAID TO POVV FOR THE SERVICE IN THAT PERIOD (OR USD $100 IF YOU PAID NOTHING). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE JURISDICTIONS THESE LIMITS APPLY TO THE FULLEST EXTENT PERMITTED.
Nothing in this Section excludes or limits liability that cannot lawfully be excluded — including liability for death or personal injury caused by negligence, for intentional misconduct or gross negligence, or under mandatory consumer-protection law. If you are a consumer, this Section applies only to the extent Polish and EU law permit.
11. Indemnification
You will defend and indemnify POVV against claims arising from your breach of Section 3 or 5 — including any claim that you lacked rights to submit a repository or that your use of a Verdict against a third party was unlawful.
12. Termination
You may stop using the service at any time. POVV may suspend or terminate accounts that breach these terms. Sections 2–4 and 7–11 survive termination. Sealed Verdicts remain cryptographically verifiable after termination.
13. Governing law and disputes
These terms are governed by the laws of Poland. For business customers, the competent courts of the Republic of Poland have exclusive jurisdiction. If you are a consumer resident in the European Union, nothing here deprives you of the mandatory protections of the law of your country of residence, and you may bring proceedings in the courts of that country. EU consumers may also use the European Commission’s online dispute resolution platform.
Withdrawal rights for consumers are set out in Section 7; this Section does not restate them.
14. Changes
We may update these terms; material changes will be announced in-product or by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
15. Contact and contracting entity
“POVV” is a brand. The seller and contracting party is POVV Kacper Gardocki, a sole proprietorship (jednoosobowa działalność gospodarcza) established in Poland, NIP 9151840843, REGON 545448690, registered address al. Solidarności 68/121, 00-240 Warszawa, Poland. Every contract you enter into through this service, and every invoice for a paid plan, is with that entity — not with a separate company named “POVV”, which does not exist. Contact: [email protected].
A payment may appear on your card statement under a shortened descriptor such as “POVV” or “POVV.IO”. That descriptor is the brand; the seller of record is the entity named above and is the entity shown on your invoice.
